City Council of Cebu v Quizon GR No. L-28972, October 31, 1972

FACTS:
Respondents Mayor Quizon and Tropical Commercial Company entered into contract involving the purchase of road

construction equipment. The City Council of Cebu filed a complaint to nullify said transactions.

ISSUE:
Whether the City Council has standing to oppose the contract


RULING:
Yes. To rule otherwise would mean that no action against a city mayor’s act and contracts in the name and on behalf of

the city could ever be questioned and subjected to judicial action for nullity since no mayor would file action to question much less nullify contracts executed by him in behalf of the city and which he naturally believes to be valid and within his authority.
